State v. King, 13 NY3d 414 (2000) - Petitioner, a police officer, claimed he was denied truthful and complete information about the information and circumstances of his discharge from the police department in violation of his due process rights. Court concluded overall that petitioner failed to state a viable claim inasmuch as the CPL did not apply because petition did not allege that he had a right under a statute to truthful and complete information about the information and circumstances of his discharge. Since the CPL did not apply, the conflict in the interest as between the police department and petitioner was at most an ordinary citizen-public servant conflict and not one of a police officer's `right and interest' with the department. 7211a4ac4a
